1. Acceptance of Terms
   By accessing or using the EC Pohl & Co’s Client Portal (“the Portal”), you agree to be bound by these Terms and Conditions. These terms govern your access to sensitive financial data and personal records. If you do not agree to these terms, you must cease use of the Portal immediately.
2. Nature of the Service

Data displayed is for informational purposes; while we strive for accuracy, you should verify all figures with your advisor before making significant financial decisions.

• 2.1 General Information: The Portal is a secure platform designed to facilitate the exchange of financial information, personal identifiers, and professional advice.
• 2.2 Historical Data: We will use our best efforts to ensure the accuracy and integrity of historical data and records maintained within the Portal; however, such data is not guaranteed.
• 2.3 Error Reporting: If you identify a possible error or inconsistency in any historical data or current records, you must notify our customer service team as soon as practical to allow for investigation and correction.
• 2.4 Verification: You should verify all figures with your advisor before making significant financial decisions based on Portal data.

3. Privacy and Data Protection
   We handle all personal identifiers and financial records in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. By uploading data, you warrant that you have the legal right to disclose such information to us.
4. Account Security and Authentication

• 4.1 Confidentiality of Credentials: You are strictly responsible for maintaining the confidentiality and security of your Portal login credentials, including your username, password, and any Multi-Factor Authentication (MFA) tokens or codes. You must not share these credentials with any third party.
• 4.2 Multi-Factor Authentication (MFA) Requirement: To protect your sensitive information, the use of MFA is mandatory. You agree to maintain a secure and active MFA method (such as an authenticator app) as required by the Portal’s security settings.
• 4.3 Right to Rely on Authentication: You acknowledge and agree that the combination of your unique password and the associated MFA code serves as your electronic signature.
  • Deemed Authorisation: We are entitled to assume that any person accessing the Portal using your valid credentials and MFA is either you or has been expressly authorised by you to act on your behalf.
  • Reliance on Instructions: We are entitled to rely—without further enquiry—upon any instruction, upload, or transaction performed within the Portal following a successful login. We are not liable for any loss or unauthorised disclosure of data resulting from the use of your credentials by a third party, whether or not such use was authorised by you.
• 4.4 Security Breach Notification: You must notify us immediately if you suspect your password or MFA device has been compromised. Until you notify us and we have had a reasonable opportunity to suspend your account, you remain responsible for all activity conducted through your account.

5. Permitted Use and Restrictions
   You must use the Portal only for its intended business purpose. You are prohibited from attempting to bypass encryption, “scraping” data via automated means, or attempting to access the records of any other client.
6. Limitation of Liability
   To the maximum extent permitted by law, EC Pohl & Co shall not be liable for any indirect, incidental, or consequential damages arising from the loss of data or unauthorised access to the Portal, provided we have maintained industry-standard security protocols. Our liability is limited to the resupply of the services or the cost of having the services supplied again.

7 Interactive Projections and User Inputs: The Portal may provide interactive tools that allow you to model future financial scenarios. You acknowledge and agree that:

• User-Defined Variables:Any results, charts, or projections generated are directly dependent on the inputs you provide, including but not limited to rate of return, contribution amounts, and start or end dates.
• Illustrative Nature:Changes to these variables will produce different results. These results are for illustrative and hypothetical purposes only and do not constitute financial advice or a guarantee of actual performance.
• Indicative Only:Calculations are based on mathematical formulas and simplified assumptions that may not reflect real-world fees, taxes, or market volatility.
• Market Risk:Investment involves significant risk. Future returns are not guaranteed. Actual market conditions can result in your invested assets being worth less than today, or in extreme cases, reducing to zero.

8. Electronic Communications
   You agree that electronic signatures and notices delivered through the Portal satisfy any legal requirement that such communication be in writing.
9. Termination of Access
   We reserve the right to suspend or terminate your access to the Portal without notice if we detect a security threat, suspicious activity, or a breach of these terms.
